Terms of Service

These terms govern your use of Job On The Block (jobontheblock.com), operated by Job On The Block LLC, a California single-member limited liability company. Please read them carefully. By using the service you agree to these terms.

  • We connect workers and employers — we don't employ anyone ourselves.
  • You must be 18 or older and live in the United States.
  • Be honest, be respectful, and follow the law.
  • Employers pay workers directly. We never handle wages.
  • You can delete your account anytime from your profile.

1. Who we are

Job On The Block is a two-sided local hiring marketplace, available as a web app and Progressive Web App (PWA) in the United States. The service is operated by Job On The Block LLC, a California single-member limited liability company ("we", "us", "our"). We can be reached at help@jobontheblock.com.

References to "Job On The Block LLC" include any successor legal entity formed for this business.

2. Eligibility

  • You must be at least 18 years old. You confirm this by checking the eligibility box on the final step of onboarding.
  • You must reside in, and use the service from, the United States.
  • Workers must have the legal authorization to work in the United States.
  • Employers must represent a legitimate business or household and have authority to post and hire on its behalf.
  • One account per person. Do not share credentials.

3. Accounts

We support sign-in with Google or Apple. We never store passwords. You can switch between the worker and employer roles from your profile.

You are responsible for keeping access to your sign-in method (email inbox, Google/Apple account) secure.

4. We are a platform, not an employer or staffing agency

Job On The Block is a venue that helps workers and employers find each other. We do not employ workers, do not run background checks, do not verify employer or worker credentials, and do not guarantee any hire, income, or worker quality. Any hiring decision, employment relationship, wage payment, tax filing, and workplace conduct is solely between the worker and the employer.

Job On The Block is not a staffing agency, employment agency, talent agency, professional employer organization (PEO), or labor contractor (including a "labor contractor" within the meaning of California Labor Code §2810.3). We do not recruit, screen, refer, supervise, dispatch, place, train, or pay workers. We do not act as a "client employer," "joint employer," or "co-employer" of any user. Worker-classification laws — including California AB5 and ABC-style tests — apply to the relationship between the worker and the employer, not to Job On The Block LLC.

5. Worker terms

  • Voice intros, photos, and tags you upload must be your own and accurate.
  • Apply only to jobs you are realistically available for.
  • Treat employers and other workers with respect. No harassment, discrimination, or threats.
  • Do not attempt to receive payment for work outside of what was agreed with the employer.
  • Ratings you give must be honest and based on first-hand experience.

6. Employer terms

  • Job posts must be accurate, lawful, and reflect a real opening.
  • Pay must meet or exceed the applicable federal, state, and local minimum wage. We surface a wage-floor check to help, but compliance is your responsibility. By submitting a job post, you attest that the wage you have entered meets all applicable minimum-wage, overtime, prevailing-wage, and tipped-employee rules.
  • Do not post discriminatory criteria (race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, genetic information, or any other protected class).
  • You are the employer of record. Hiring, onboarding, I-9, W-4, payroll, taxes, workers' compensation, and workplace safety are your responsibility.
  • Do not use the platform to circumvent fees by contacting workers outside our app before unlocking contact.

7. Payments and fees

Payment processing is handled by Stripe. We do not store full card numbers. The service may include:

  • Employer subscriptions (monthly recurring).
  • Pay-per-contact unlocks for workers' contact info (first 2 unlocks per month are free).
  • Optional one-time add-ons for workers (e.g. visibility boosts).

We do not act as a payroll service. Wages and any other compensation flow directly from the employer to the worker outside of the platform.

Refunds

All fees are non-refundable except where required by law. Specifically: (a) subscription fees are non-refundable for the current billing period, including any unused portion; (b) contact-unlock fees are non-refundable once the contact information has been revealed; (c) one-time visibility add-ons (e.g. featured or urgent boosts) are non-refundable once activated; (d) failed payments may result in temporary loss of premium features until the payment method is updated. If you believe a charge is in error, email us within 30 days at the address in section 18 and we will review it in good faith.

8. AI features, matching, and not-a-CRA

We use AI to transcribe voice intros (OpenAI Whisper) and to suggest matches between jobs and workers (Lovable AI Gateway with embeddings). AI outputs — including match scores, relevance scores, reputation metrics, ratings, and ranking suggestions — are assistive informational signals only. You are responsible for what you ultimately post, apply to, or hire.

Job On The Block is NOT a consumer reporting agency ("CRA") under the federal Fair Credit Reporting Act (15 U.S.C. §1681 et seq.) or any state analogue (including the California Investigative Consumer Reporting Agencies Act). We do not provide consumer reports, investigative consumer reports, or background checks. Employers may not use our outputs as the sole basis for any adverse action against a worker (denial of hire, demotion, termination, or any other employment-related decision) and must conduct their own lawful, independent evaluation.

Our matching does not use protected-class attributes (race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, genetic information, marital status, citizenship status, or any other class protected by federal, state, or local law) as input features. Match scores reflect skills/experience similarity and distance — not demographic characteristics. Employers remain solely responsible for compliance with the Equal Credit Opportunity Act, Title VII, ADA, ADEA, the California Fair Employment and Housing Act, and all other anti-discrimination laws.

9. Content license

You retain ownership of content you upload (photos, voice intros, job descriptions, messages, ratings). You grant Job On The Block LLC a worldwide, non-exclusive, royalty-free license to host, store, display, translate, transcribe, moderate, and back up that content for the purpose of operating and improving the service. We do not sell your content, do not license it to advertisers, and do not provide it to third parties to train foundation models beyond what is required to fulfill the specific AI request you initiate.

10. Acceptable use

You agree not to:

  • Scrape, crawl, or copy the service or its data by automated means.
  • Impersonate any person or business, or create fake reviews or accounts.
  • Harass, threaten, defame, or discriminate against any user.
  • Post unlawful, fraudulent, or misleading content.
  • Bypass contact-unlock fees by soliciting contact outside our app.
  • Use the service for anyone under 18.

11. Reputation and ratings

After a shift or hire, both sides can rate each other. One rating per completed shift or hire. For ongoing roles, the rating window opens after 7 days. We do not remove ratings in exchange for payment. To dispute a rating you believe violates these terms, open the rating in your profile and tap "Report a problem" (Settings → Help Center → Report a rating problem). A moderator will review your request and you'll be notified of the outcome in your inbox.

12. Suspension and termination

We may suspend or terminate your account, with or without notice, for breach of these terms, suspected fraud, abuse, safety risk, or to comply with law. You may delete your account at any time from Settings → Danger zone. Data retention after deletion is described in the Privacy Policy.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOU WILL BE HIRED, EARN ANY INCOME, OR FIND A QUALIFIED WORKER, AND WE MAKE NO REPRESENTATIONS ABOUT THE CONDUCT, QUALIFICATIONS, OR LEGAL STATUS OF ANY USER.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JOB ON THE BLOCK LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD 100) OR (B) THE FEES YOU PAID TO US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

15. Indemnification

You agree to indemnify and hold Job On The Block LLC harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from (a) content you post, (b) your hiring or employment decisions and the wages, taxes, and workplace conditions associated with them, (c) your violation of these terms or any law, or (d) your interaction with another user.

16. Changes to these terms

We may update these terms from time to time. Material changes will be shown as an in-app banner on your next visit (and emailed when we have a verified address on file). If you keep using the service after that date, you accept the update.

17. Governing law, arbitration, and class-action waiver

These terms are governed by the Federal Arbitration Act and, where state law applies, by the laws of the State of California, USA, without regard to its conflict-of-laws rules.

Binding individual arbitration

You and Job On The Block LLC agree that any dispute, claim, or controversy arising out of or relating to these terms or the service will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, or, at the claimant's election, the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, on the documents, by video, or in the federal judicial district where you reside, at your option. The arbitrator's award is final and may be entered in any court of competent jurisdiction.

Small-claims and PAGA carve-outs

Either party may bring an individual action in small-claims court for any claim that qualifies, instead of arbitration. Nothing in this section waives any non-waivable right under the California Private Attorneys General Act of 2004 (Labor Code §2698 et seq.) ("PAGA") to bring a representative action on behalf of the State of California for Labor Code violations; any individual PAGA claim, however, is subject to arbitration to the extent permitted by law.

Class-action waiver

YOU AND WE EACH AGREE THAT DISPUTES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING (other than a non-waivable PAGA representative claim). The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class-action waiver is found unenforceable as to any particular claim or remedy, then that claim or remedy (and only that claim or remedy) will be severed and brought in court, while the remaining claims continue in arbitration.

30-day opt-out

You may opt out of this arbitration agreement by sending a written notice to help@jobontheblock.com with the subject line "Arbitration Opt-Out" within 30 days after you first accept these terms (or, for users who accepted a prior version, within 30 days after the effective date of this update). Your notice must include your name, the email address on your account, and a clear statement that you are opting out. Opting out will not affect your ability to use the service.

Venue for non-arbitrable disputes

For any dispute not subject to arbitration (including small-claims actions or claims to enforce or vacate an arbitration award), the exclusive venue is the state or federal courts located in California, and you consent to personal jurisdiction there.

20. Accessibility

We design Job On The Block as a mobile-first Progressive Web App and target the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you encounter an accessibility barrier or need an accommodation to use the service, email help@jobontheblock.com with the subject line "Accessibility". We aim to acknowledge accessibility reports within 5 business days. See the Accessibility Statement at /legal/accessibility for the current status and how to report a barrier.

21. California disclosures

California residents have additional rights under the California Consumer Privacy Act and California Privacy Rights Act (CCPA/CPRA) — see our Privacy Policy sections on California rights, Notice at Collection, and Sensitive Personal Information. We do not sell or share personal information for cross-context behavioral advertising; the "Do Not Sell or Share My Personal Information" link is provided in the site footer and in Settings → Legal. Voice Recordings are treated as Sensitive Personal Information under the CPRA and are used only for the operational purpose you initiated (transcribing and displaying your intro).
